Terms & Conditions

These Terms apply to all orders placed with Schneiderei & Putzerei DUMAN, Silbergasse 18, 1190 Vienna. Effective: [insert date]. The legally binding version is the German text under /agb/; this English translation is provided for convenience.

Note: This is a template. Please have it reviewed by a lawyer or by the Vienna Chamber of Commerce (Wirtschaftskammer Wien, legal services) before it takes effect. Items marked [placeholder] must be adapted.

1. Scope

These General Terms and Conditions (GTC) apply to all orders, services and deliveries by Schneiderei & Putzerei DUMAN ("the Business") to consumers and businesses, unless otherwise agreed in writing. The Business provides both alteration tailoring and dry cleaning services.

2. Formation of contract

The contract is formed by handing over the garment or textile and the Business's verbal acceptance of the order. Before accepting, the Business informs the customer of any specific considerations, estimated price and expected completion date.

3. Prices & payment

Prices stated in the shop and on the website are starting values in euros, including statutory VAT where applicable. The final price is confirmed after assessing the item. Payment is due on collection in cash or by [card / bank card / other accepted payment methods].

4. Collection & storage

Completed items must be collected within [e.g. three months] of the notified completion date. After this period, the Business may charge a reasonable storage fee or, after written notice, dispose of the item in accordance with statutory provisions.

5. Warranty

Statutory warranty provisions apply. Defects must be reported without undue delay. Within warranty, the Business will rectify the defect; if rectification is not possible or reasonable, a proportionate price reduction may be granted in accordance with statutory provisions.

6. Liability

The Business is liable for damages only in cases of intent or gross negligence. Liability for slight negligence is excluded to the extent permitted by law. This limitation does not apply to personal injury or claims under the Austrian Product Liability Act. No liability is accepted for valuables left in garment pockets; customers are kindly asked to empty pockets before handover.

7. Material properties & risks (alterations)

For heavily worn, damaged or particularly delicate materials (e.g. leather, fur, silk, sequins, coated fabrics), the Business will point out potential risks before accepting the order. Even with proper workmanship, unavoidable marks may occur in such cases; liability for these is excluded.

8. Dry cleaning – notes & risks

Dry cleaning is carried out according to the care instructions on the label. If care labels are missing or illegible, cleaning is performed at the Business's professional discretion at the customer's risk. For particularly delicate fabrics, decorations, glued elements, older stains and for leather, fur and wedding garments, unavoidable changes (e.g. colour deviations, shrinkage, loosening of decorations) may occur despite proper treatment; no liability is accepted for these. We point out identifiable risks before accepting the order.

9. Withdrawal & cancellation

Alterations are made to customer specification and qualify as goods produced according to customer specifications within the meaning of § 18 (1) (3) of the Austrian Distance and Off-Premises Contracts Act (FAGG). Dry cleaning is also provided in relation to the specific order. Consumers therefore have no statutory right of withdrawal once work has begun.

10. Data protection

Personal data is processed solely for performing the contract and meeting legal obligations. Details: see the privacy policy at [insert privacy policy link].

11. Jurisdiction & applicable law

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is the competent court in Vienna, subject to mandatory legal provisions.

12. Severability

Should any provision of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by one whose effect comes closest to the original economic intent.
